Interviewing Steve Bliss

Good morning, San Diego and welcome to another edition of San Diego Legal Matters. Today we’re joined by probate attorney Steve Bliss of San Diego Probate Law. Steve, thanks for joining us.

Steve Bliss: Thanks for having me

Steve, many people put off estate planning until it’s too late. Can you tell our viewers why this step is so important and perhaps walk us through one key step in the process?

Choosing an Executor or Trustee

Absolutely. Estate planning isn’t just for the wealthy; everyone needs a plan, regardless of their financial standing. It provides peace of mind knowing your loved ones will be cared for according to your wishes, and it minimizes potential conflicts and legal issues down the road.

One crucial step is selecting an executor or trustee. This individual or entity will manage your estate after you’re gone, carrying out the instructions outlined in your will or trust. Consequently, choosing someone trustworthy, responsible, and capable of handling financial matters is paramount.

Consider factors like their organizational skills, communication abilities, and willingness to take on this important role. You want someone who can navigate legal processes, manage assets, pay debts and taxes, and distribute inheritance according to your wishes.

Moreover, it’s wise to discuss your decision with the potential executor or trustee beforehand. Ensure they understand the responsibilities involved and are comfortable accepting the role. Open communication helps prevent surprises and ensures a smoother transition for everyone.

Challenges and Considerations

I recall a case where a client named their adult child as executor without discussing it beforehand. The child felt overwhelmed by the responsibility and lacked the financial acumen to handle complex investments. Ultimately, we had to appoint a professional trustee to step in, which added time and expense to the process.

Fortunately, most people choose wisely. I’ve seen countless instances where families are deeply grateful for having a designated executor who navigates the complexities of probate with care and compassion. Notwithstanding these challenges, selecting the right person makes a world of difference during an already difficult time.

Peace of Mind

According to the American Bar Association, over 50% of Americans don’t have a will or estate plan in place. That’s a staggering statistic highlighting the need for greater awareness about this critical issue.

Remember, estate planning is not just about dividing assets; it’s about protecting your loved ones and ensuring your legacy lives on.
