If there’s a valid will, it needs to be submitted along with the petition. This document outlines the deceased person’s wishes regarding asset distribution and often designates a specific executor. Ordinarily, if the will is unclear or doesn’t name an executor, the court appoints someone suitable.
It’s important to remember that probate isn’t always necessary. If the estate falls below the California threshold of $184,500 and consists primarily of non-probate assets like jointly held property or assets in a trust, it might be possible to bypass probate altogether.
