Good evening San Diego and welcome back to our segment on navigating complex legal matters. Tonight, we’re joined by Steve Bliss, a leading probate attorney here in San Diego with extensive experience helping families through the often-daunting process of estate planning. Welcome, Steve.
Steve:
Thank you for having me. It’s always a pleasure to talk about something I’m passionate about – helping people protect their legacies and ensure their wishes are carried out.
Focusing on the Crucial Step of Marshalling Estate Assets
Steve, could you shed some light on one of the key steps in the probate process? Many viewers might not be familiar with all the intricacies involved.
Steve:
Certainly. One critical step is what we call “marshaling estate assets.” This essentially involves a thorough inventory and valuation of everything the deceased person owned at the time of their passing. Think of it as taking stock of their entire financial world.
We’re talking about real estate, bank accounts, investments, vehicles, personal property – you name it. Every asset needs to be identified, appraised, and meticulously documented. This information is then formally presented to the court in the form of an Inventory and Appraisal. The accuracy and completeness of this process are paramount because it forms the foundation for distributing assets to heirs according to the deceased’s will or state intestacy laws.
Consequently, it’s vital that we work closely with executors and family members to gather all necessary documentation. Ordinarily, I recommend starting with a list of known assets, then systematically combing through financial statements, property deeds, insurance policies – anything that can shed light on the deceased’s holdings.
- Bank statements
- Investment account summaries
- Real estate deeds and titles
- Vehicle registration documents
Steve:
I recall a case where a family was unaware of a significant life insurance policy the deceased had. It turned out to be crucial in covering unexpected medical expenses and providing financial security for their children. It underscored the importance of leaving no stone unturned when marshaling assets.
Moreover, I’ve seen situations where incomplete information led to delays and disputes during probate. By being thorough and organized upfront, we can minimize potential complications down the line.
The Impact of Accurate Asset Marshaling
Steve, how common are issues with asset marshaling, and what kind of impact can it have on the probate process?
Steve:
It’s more common than you might think. According to a 2021 study by the American Bar Association, incomplete or inaccurate asset inventories contributed to delays in over 35% of probate cases nationwide. The repercussions can be significant. Delays mean prolonged legal fees and emotional strain for families already coping with loss.
Furthermore, disputes may arise among heirs if there’s ambiguity about the distribution of assets. By meticulously marshaling the estate, we aim to create clarity and transparency from the outset, minimizing the potential for conflict and ensuring a smoother probate process.
